Failure to pay traffic camera fines for motorbikes may suspend many procedures

Recently, Hàng Xanh Traffic Police (PC08, HCMC Police) published a list of 201 motorbikes fined by traffic cameras for riding on sidewalks in Gò Vấp and Bình Thạnh districts on September 17–18. The move sparked public attention, as riding on sidewalks is a common problem in HCMC, especially during rush hours. While many supported stricter enforcement, some riders claimed they were not worried, arguing that motorbikes are not bound by vehicle inspections like cars, so “ignoring” fines would cause no consequence.

Consequences of not paying fines
Lawyer Đỗ Khắc Tất Hưng (HCMC Bar) explained that under Decree 168/2024, when traffic camera fines are issued, authorities notify the vehicle owner to resolve the violation. If the offender fails to comply, notices are sent to vehicle registration, licensing, or inspection agencies. These agencies will then suspend related procedures until the fine is settled.

For motorbikes, which are not subject to periodic inspection (per Decree 166/2024), unpaid fines prevent owners from completing procedures related to the violating motorbike, such as transferring ownership, selling, or handling motorcycle license matters (issuance, renewal, replacement).

Additionally, under the Law on Handling Administrative Violations (2012, amended 2020 and 2025), overdue fines may result in:

  • Enforcement measures such as wage deduction or bank account garnishment.

  • Late payment penalties at 0.05% per day of the unpaid fine.

Is the fine void after one year?
Lawyer Nguyễn Đình Thế (HCMC Bar) clarified that the statute of limitations for enforcing a fine is one year from the date of the decision. After that, the decision is no longer enforceable, except when confiscation of property or remedial measures are involved. If the offender deliberately avoids payment, the one-year period only starts after avoidance ends.

Also, Circular 79/2024 (Ministry of Public Security) states that anyone failing to comply with traffic fine requirements will not be allowed to register, transfer, or inherit vehicles until fines are cleared.

Payment methods
Drivers have several options to pay fines:

  • In person at local traffic police offices (suitable for contesting violations or clarifying details).

  • Through the State Treasury (direct payment or bank transfer).

  • Online via the National Public Service Portal or the Ministry of Public Security’s portal.

  • At post offices, which forward payments to authorities within 2–3 working days.

Conclusion
Unpaid traffic camera fines for motorbikes do not disappear. They block administrative procedures related to the vehicle and may lead to additional penalties or enforcement measures. Settling fines promptly is necessary to avoid long-term complications.
