The Ministry of Home Affairs has submitted to the Ministry of Justice a draft decree detailing several provisions of the Employment Law, focusing on regulations for working hours, overtime compensation, and training support policies.

According to the draft, employees are limited to a maximum of 8 working hours per day and must be given at least one day off per week. In cases where work cycles do not allow weekly rest, employers must ensure a minimum of four rest days per month. If overtime is required, the total of regular and extra working hours must not exceed 12 hours per day.

Overtime wages are clearly defined: at least 150% of the normal rate for weekdays, 200% for weekly rest days, and 300% for public holidays or Tet.

The draft also introduces support policies for vocational training, especially targeting rural workers and young people who have completed military service or volunteered in socio-economic development projects. These groups may receive support for short-term training programs (basic level or under three months). Tuition fees are covered up to a maximum of 4 million VND per course. For young people, total support is capped at the equivalent of 12 months of the statutory base salary.

In addition, trainees will receive daily allowances of 50,000 VND for meals and living expenses. Travel support is set at 200,000 VND per course if the training site is 15 km or more from their residence, and 300,000 VND for those living in socio-economically disadvantaged areas located at least 10 km from the training center.

For workers preparing to take jobs overseas, the draft provides financial aid for pre-departure orientation courses. Each trainee is entitled to 530,000 VND per course, plus allowances of 50,000 VND per day for meals, 400,000 VND per month for accommodation, and additional travel support under the same distance-based rates.

Those who need advanced training in professional skills or foreign languages to qualify for overseas employment can also receive up to 4 million VND per course, with the same allowances for meals, housing, and travel as above.

These new policies, set to take effect in early 2026, are designed to improve labor conditions, ensure fair compensation for overtime, and strengthen the workforce’s capacity to compete in both domestic and international markets.
