Conditions for acquiring Vietnamese nationality
According to Article 19 of the 2008 Law on Nationality, foreigners or stateless persons permanently residing in Vietnam may apply for naturalization if they meet the following requirements:
Full civil capacity under Vietnamese law.
Respect for the Constitution, laws, traditions, and customs of Vietnam.
Proficiency in Vietnamese sufficient for community integration.
Permanent residence in Vietnam for at least five years up to the time of application.
Ability to secure a stable livelihood in Vietnam.
Certain applicants may be exempt from some of these conditions, including spouses, parents, or children of Vietnamese citizens; individuals with special contributions to the country; or cases deemed beneficial to the State.

Applicants for naturalization are generally required to renounce their original nationality, unless the President grants an exception. They must also choose a Vietnamese name, which will appear in the official decision on nationality.
Application dossier for Vietnamese nationality
As provided under Article 20 of the 2008 Law on Nationality, the application must include:
Application form for Vietnamese nationality.
Copy of birth certificate, passport, or valid substitute document.
Personal résumé.
Judicial record issued in Vietnam (within 90 days) and from the foreign authority covering periods of residence abroad.
Documents proving Vietnamese language proficiency.
Documents verifying lawful residence and length of permanent stay in Vietnam.
Documents proving financial capacity to sustain life in Vietnam.
Those eligible for exemptions under Article 19 may be excused from submitting certain documents.
Procedures for naturalization in Vietnam
Article 21 of the 2008 Law on Nationality sets out a multi-step process:
The applicant files the dossier with the provincial Department of Justice. Incomplete applications must be supplemented.
Within five working days, the Department of Justice requests the provincial police to verify the applicant’s identity. Police have 30 days to report back.
Within ten days of receiving the police report, the Department of Justice finalizes the file and submits it to the provincial People’s Committee Chairman.
The Chairman has ten working days to review, conclude, and send recommendations to the Ministry of Justice.
Within twenty days, the Ministry of Justice reviews the file. If eligible, the applicant is notified to complete procedures to renounce their foreign nationality, unless they are allowed to retain it. Afterward, the Ministry reports to the Prime Minister to forward to the President.
Within thirty days of the Prime Minister’s submission, the President considers and issues the final decision on naturalization.
In summary, foreigners seeking Vietnamese nationality must satisfy strict conditions on residence, legal capacity, language, and livelihood. The dossier requires comprehensive documentation, and the approval process involves multiple levels of verification, from provincial authorities to the Ministry of Justice, Government, and ultimately the President.
